1 Jimmy Goodner, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Bryan County, Case No. CRF-74-98, with the crime of Unlawful Possession of Marijuana with Intent to Distribute, in violation of 63 O.S. 1971 ? 2-401 [63-2-401] _ B 2. The trial court sentenced the defendant to a term of five (5) years in the State Penitentiary and a fine of One Thousand Dollars ($1,000.00), and he appeals.
